LIQUIDATION AND IMPAIRMENT ORDERS

On May 2, 2019, a Wisconsin court found Northwestern National Insurance Company of Milwaukee, Wisconsin (“NNIC”) insolvent and placed the company in liquidation. See order. The Texas Commissioner subsequently designated the company an “impaired insurer.” See order. These events trigger the obligations of the Texas Property and Casualty Insurance Guaranty Association (“TPCIGA”) to handle certain Texas claims arising under NNIC policies under the Texas Property and Casualty Insurance Guaranty Act, found at TEX. INS. CODE Ch. 462.


INSURANCE POLICY AND COVERAGE INFORMATION

The Liquidation Order cancels all property and casualty policies 15 days from the date of the Order, unless otherwise cancelled or replaced before then.


CLAIMS INFORMATION

The Wisconsin Office of the Commissioner of Insurance (“OCI”) is arranging for the transfer of claim files and data to TPCIGA for handling. Please report new claims and direct inquiries on existing claims prior to the transfer to the Special Deputy Liquidator for Northwestern National Insurance Company of Milwaukee, Wisconsin, Office of the Commissioner of Insurance, P.O. Box 7873, Madison, Wisconsin 53707-7873 or by email to ocinnicliquidation@wisconsin.gov. You may also visit Wisconsin.Gov for additional information about the liquidation.


STAY OF LITIGATION

Pursuant to TEX. INS. CODE §462.309, lawsuits pending in Texas in which NNIC is a party or is obligated to defend a party are automatically stayed for six months to allow TPCIGA time to receive and review the claims. Additionally, the Liquidation Order enjoins all persons from pursuing the assets of NNIC other than through the liquidation proceeding, which includes any lawsuits filed directly against NNIC.


PRIOR OR PENDING SETTLEMENTS

TPCIGA is not bound by a settlement or release entered into by NNIC or its insureds, and such a settlement is not evidence of liability or damages against TPCIGA or an insured. TEX. INS. CODE §462.303.
